Kalau dah tertandatangan 58 ke&lt;br /&gt;dia minta reverse semula.   tapi malangnya aku ada kerja lain kena bereskan..&lt;br /&gt;tak sempat aku nak dengar panjang lebar. Korang tak merasa gaji masuk RM 235.000 dan mati Kong tak sampai 1K..&lt;br /&gt;&lt;br /&gt;k... renung2kan lah... perasaaan ati orang laen..&lt;br /&gt;&lt;br /&gt;Di dalam SBPA Pelukis yang jawatannya telah dijumudkan akan berada di dalam kumpulan Pelaksana Berkelayakan SPTM.&lt;br /&gt;&lt;br /&gt;bil 11. &lt;br /&gt;&lt;br /&gt;   Didalam Sistem Saraan Malaysia ( SSM ) terdapat Juruteknik/Pelukis Pelan J-17 mereka akan dipindahkan ke JA3-1, Juruteknik/Pelukis Pelan J-22 akan dipindahkan ke JA3-2 dan seterusnya Juruteknik/Pelukis Pelan J-26 akan mengisi JA3-3&lt;br /&gt;&lt;br /&gt;Bagi pelukis pelan yang belum mencapai 6 tahun perkhidmatan dan tidak mempuyai kelayakan akan masih KUP, sehinggalah cukup tahun perkhidmatan..&lt;br /&gt;&lt;br /&gt; &lt;br /&gt;Didalam Perkhidmatan Awam Pelukis Pelan ditempatkan &lt;br /&gt;dipelbagai jabatan, contohnya,&lt;br /&gt;1. Pejabat JKR&lt;br /&gt;2. Pejabat Majlis Daerah&lt;br /&gt;3. Pejabat Hutan&lt;br /&gt;4. Pejabat Perancang Bandar dan Desa&lt;br /&gt;5. Pejabat Daerah&lt;br /&gt;6. Pejabat Tanah&lt;br /&gt;7. Contohnya Layer A menggunakan Kodinit Cassini NS/Melaka dan yang satu lagi menggunakan kodinit Longitud dan Latitud. Untuk itu kita perlu menjadikan lukisan itu menggunakan Projection yang sama. Caranya,&lt;br /&gt;&lt;br /&gt;1. Savekan lukisan yang hendak diubah ke Save as ....namakan yang baru.&lt;br /&gt;2. Choose Projection  - Non-earth - Non-earth ( Meters )&lt;br /&gt;3. Non Earth Coordinate Bounds - Set kepada minimum = -10000000 dan maximum 10000000&lt;br /&gt;4. Gunakan Translator dan traanslate kepada ESRI.&lt;br /&gt;5. Kawasan tersebut telah diwartakan sebagai Tanah Rizab Melayu, Hakmilik tidak dicop sebagai Tanah Rizab Melayu, dan tanah tersebut telah diduduki orang bukan melayu (Pegangan Melayu )sebelum pengwartaan tanah tersebut dilaksanakan. Soalan saya ialah apabila tuantanah membuat permohonan serahbalik dan berimilik semula atau Tukarsyarat/psempadan dan permohonan tersebut diluluskan. Adakah dicop hakmilik tersebut Sebagai Tanah Rizab Melayu semasa mendaftarkan tersebut, walaupun ianya masih dipegang Oleh Orang Bukan Melayu.&lt;br /&gt;&lt;br /&gt;Jawapannya ialah:&lt;br /&gt; &lt;br /&gt;Oleh kerana pemilik tanah tersebut bukan melayu maka tidak boleh dicop atau diendos dengan satu permintaan dalam Borang A Enakmen Rizab Melayu Negeri Sembilan diatas hakmilik tersebut kerana bercanggah dengan sek 6 (vi) Enakmen Rizab Melayu Negeri Sembilan 1933 seperti berikut:&lt;br /&gt;6(vi)   Walau apapun saja yang terkandung di dalam seksyen ini, pihak berkuasa pendaftaran yang sepatutnya hendaklah jangan membuat apa-apa peringatan di bawah seksyen ini ke atas dokumen hakmilik daftar atau hakmilik keluaran bagi mana-mana tanah di mana tuanpunya tunggalnya bukannya seorang Melayu atau tidak seorang jua pun daripadanya tuanpunya-tuanpunya bersamanya orang Melayu.&lt;br /&gt; &lt;br /&gt;Ini bermakna bahawa walaupun tanah tersebut melalui proses tukar syarat dan pecah sempadan, namun cop atau endosan sebagai pegangan melayu tidak boleh dilakukan oleh Pentadbir Tanah. &lt;br /&gt; &lt;br /&gt;Tetapi harus diingat jika pemilik (bukan melayu) telah membuat permohonan serahbalik dan berimilik semula melalui sek 204D KTN (menggunakan Borang 12D), maka pemberimilikan semula oleh Pihak Berkuasa Negeri kepada pemilik asal (bukan melayu) adalah dilarang oleh sek 7  Enakmen Rizab Melayu Negeri Sembilan seperti berikut:&lt;br /&gt; &lt;br /&gt;7.         Sekatan berhubung dengan pemberimilikan.                   &lt;br /&gt; &lt;br /&gt;Tiada apa jua tanah Kerajaan yang termasuk ke dalam satu Rizab Melayu boleh dijual, dipajak atau dilupuskan dengan cara lain kepada mana-mana orang yang bukannya seorang Melayu :&lt;br /&gt; &lt;br /&gt;Dengan syarat Raja Dalam Majlis Mesyuarat Kerajaan Nageri boleh memberi milik tanah Kerajaan yang termasuk ke dalam satu Rizab Melayu kepada mana-mana pertubuhan perbadanan atau syarikat yang dipertetapkan di dalam Jadual Ketiga, di mana Raja dalam Majlis Mesyuarat Kerajaan Negeri boleh, dengan perintah  yang diterbitkan di dalam Warta, menambah kepada, memotong daripada, atau meminda dari masa ke semasa.&lt;br /&gt; Selain dari itu terdapat nama pemilik lain Rahmah Binti Othman 5/8 keluasan tanah adalah satu ekar.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;soalan.&lt;br /&gt;&lt;br /&gt;Apakah boleh dipindahmilik tanah tersebut 1/8 bahagian seperti yang tercatit di dalam hakmilik tersebut dipindahmilik kepada orang lain?&lt;br /&gt;&lt;br /&gt;Berdasarkan kepada hakmilik manual tidak akan wujud nama azizah dua kali dicatitkan, semua bahagian akan dikumpul. Jumlah share yang dimiliki oleh azizah adalah 3/8 bahagian. Kemungkinan sistem SPTB tidak mengumpulkan bahagian tersebut kerana i/c berlainan ( satu i/c baru dan yang satu lagi i/c lama )atau alamat berlainan. Dan ini tidak berlaku didalam sistem manual jika pemiliknya adalah orang yang sama.&lt;br /&gt;Dilam kes ini sepatutnya bahagian 1/4 atau 1/8 tidak boleh di pindahmilik secara berasingan sekiranya PTD mengetahui bahawa tanah tersebut dipegang oleh orang yang sama kerana tanah tersebut kurang dari seekar. Setelah disemak didapati Penggunaan Tanah adalah Bangunan dan Syarat Nyatanya adalah Bangunan. Pengadu pernah membuat permohonan tukar syarat Pecah Sempadan daripada pertanian kepada bangunan. Di dalam menyediakan kertas Mesyuarat ke EXCO, Pentadbir Tanah Daerah telah menyatakan dalam syarat kelulusan bahawa syarat nyata tanah adalah bangunan sahaja.Semakan juga telah dibuat ke Unit Hasil untuk mengetahui apakah kadar cukai yang telah dikenakan. Unit Hasil memaklumkan oleh kerana syarat nyata adalah Bangunan, kadar cukai tertinggi bagi bangunan ialah bangunan Perniagaan, Oleh itu pengadu telah dikenakan cukai untuk kadar Bangunan Perniagaan.&lt;br /&gt;Apakah cara penyelesaiannya?&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Cara Pertama.&lt;br /&gt;&lt;br /&gt;Pentadbir Tanah akan mengarahkan supaya dibuat satu siasatan di atas lapangan tanah yang diduduki, samada tanah tersebut telah didirikan Bangunan Kediaman atau Bangunan Perniagaan. Sekiranya tanah tersebut telah didirikan bangunan kediaman, berdasarkan lapuran tersebut boleh di pinda kadar cukai tanah daripada Bangunan Perniagaan kepada Bangunan Kediaman.&lt;br /&gt;&lt;br /&gt;Cara Kedua.&lt;br /&gt;&lt;br /&gt;Pentadbir Tanah akan membuat pembetulan ke atas Kertas Mesyuarat Exco daripada Bangunan kepada Bangunan Kediaman dan menghantar semula ke Exco untuk Kelulusan.&lt;br /&gt;Dengan kelulusan tersebut akan dibuat pindaan atas syarat nyata hakmilik tersebut daripada Bangunan kepada Bangunan Kediaman.Tanpa kelulusan Exco, Pentadbir Tanah tidak mempunyai kuasa untuk membuat pindaaan/pembetulan pada syarat nyata hakmilik tersebut ( SEK 380). Pecah Bahagian Tanah.&lt;br /&gt;&lt;br /&gt;     Kerajaan telah meluluskan pindaan kepada KTN 1960, sebelum ini tanah yang kurang daripada 1 ekar dan dimiliki bersama oleh lebih daripada seorang tidak boleh dipecah bahagian. Dengan pindaan terbaru tanah itu sudah boleh dipecah bahagian.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;2.   Apabila sekeping tanah dimiliki oleh A,  dengan bahagian 1/2 dan B  memegang baki 1/2 apabila dipecah bahagian Pentadbir/Pendaftar akan mendaftarkan dua hakmilik berasingan dengan bahagian seperti berikut &lt;br /&gt;A akan memiliki 1/1 bahagian dan juga B akan memiliki 1/1 bahagian atas keluasan tanah.&lt;br /&gt;&lt;br /&gt;Manaka pecah sempadan pula, Pentadbir/Pendaftar akan mengeluarkan hakmilik mengikut kelulusan berapa lot hakmilik itu telah diluluskan untuk dipecahkan. Setiap hakmilik akan didaftarkan nama-nama seperti yang terdapat pada hakmilik sebelumnya. Kelulusan mungkin boleh diperolehi lebih cepat..mungkin dalam satu atau dua minggu sahaja.&lt;br /&gt;Tetapi sekiranya perlu mendapat kelulusan PIhak Berkuasa Negeri mungkin mengambil&lt;br /&gt;masa tiga hingga 6 bulan.&lt;br /&gt;&lt;br /&gt;Sekiranya hakmilik tersebut tidak mempunyai apa-apa sekatan.&lt;br /&gt;Pindahmilik boleh dilakukan dalam tempoh sehari.&lt;br /&gt;&lt;br /&gt;Sekiranya permohonan ditolak...proses rayuan masih boleh dikemukakan&lt;br /&gt;Antara masaalah pindahmilik ini ialah: &lt;br /&gt;1. Geran hilang.&lt;br /&gt;2. Pemilik/tuanpunya tanah telah meninggal dunia dan tiada pentadbir dilantik&lt;br /&gt;3. Pemilik/tuanpunya tanah masih ada berhutang dagan bank dan pihak bank belum   membuat permohonan melepaskan gadaian.&lt;br /&gt;4. Pemilik tiada hakmilik beli dari pemaju dan pemaju dah bangkrap.&lt;br /&gt;&lt;br /&gt;Proses pindahmilik boleh dilakukan sendirian atau dengan melantik peguam.&lt;br /&gt;Melalui peguam:&lt;br /&gt;1.  Peguam akan membuat carian resmi.Tujuannya untuk memastikan penjual adalah pemilik yang sah seperti yang tercatit di dalam hakmilik yang didaftarkan di Pejabat Tanah berkenaan. Selepas itu draf agreement. Bayaran ansuran rumah tersebut telah habis dijelaskan oleh pemilik tanah tersebut kepada Unit Perumahan Dan Kerajaan Tempatan.&lt;br /&gt;Pemohon sekarang telah membuat permohonan tanah pula di Pejabat Tanah.&lt;br /&gt;Pejabat Tanah pula, setelah projek tersebut mendapat Kelulusan MMK telah membuat "permintaan Ukur" ke Pejabat Ukur dan Pemetaan. Pejabat Ukur pula selesai membuat pengukuran mengikut pelan yang diluluskan Pejabat Pengarah Perancang Bandar dan Desa. (mengikut banyak lot seperti pelan layout). Selepas itu Pejabat Ukur dan Pemetaan mengeluarkan Pelan Akhir yang mengandungi nombor2 lot.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;SOALAN:&lt;/strong&gt;&lt;br /&gt;1. Apakah perlu Pejabat menyediakan satu lagi PU bagi Rumah Rakyat tersebut selepas menerima bayaran premium tanah daripada peserta yang telah menjelaskan premium?&lt;br /&gt;tersebut ?&lt;br /&gt;&lt;br /&gt; JAWAPAN SAYA:&lt;br /&gt; Tidak perlu, malahan tujuan PU awal adalah untuk tujuan tersebut. dan tidak sepatutnya hakmilik sementara dikeluarkan atas lot-lot tanah tersebut sebelum mendapat hakmilik kekal kerana Lot tersebut telah selesai diukur halus. Apa yang perlu dilakukan adalah melihat semula atau mendapatkan senarai bayaran Ukur yang dikenakan kepada setiap peserta Rumah Rakyat Tersebut. atau mendapatkannya daripada Pejabat Ukur dan Pemetaan berdasarkan kepada NO. PU tersebut, malahan sekiranya senarai itu telah ada, Pembantu Tadbir sepatutnya mengutip bayaran UPAH UKUR berdasarkan list tersebut. Sebidang tanah telah diwartakan untuk cadangan pengambilan balik tanah.Diantara   lot yang terlibat sebidang tanah yang mempunyai satu hakmilik tetapi terdiri daripada 3 lot ( GM 2337 lot 756, 956 dan 355 )Oleh kerana Pentadbir Tanah bercadang untuk mengeluarkan hakmilik sambungan kepada hakmilik tersebut supaya setiap satu dari lot tersebut akan terdiri dari satu hakmilik, apakah kesannya kepada warta pengambilan yang telah disiarkan?&lt;br /&gt;&lt;br /&gt;   Jawapan:&lt;br /&gt; &lt;br /&gt;   Sebaik-baiknya Pentadbir membuat endosan pengambilan balik tersebut di keatas  hakmilik lama dan selepas itu barulah hakmilik tersebut disambung kepada hakmilik   baru. Sekiranya pengambilan balik itu hanya melibatkan satu sahaja lot contohnya,  Lot 756, sebaik sahaja hakmilik tersebut disambung, endosan yang dibuat akan hanya   terdapat pada hakmilik yang bernombor lot 756 dan tidak melibatkan lot lain. Pada masa yang sama tuan tanah tersebut masih mempunyai bebanan gadaian kepada sebuah Institusi kewangan. Adakah Pentadbir Tanah Daerah perlu menasihatkan tuanpunya tanah supaya melepaskan gadaian terlebih dahulu supaya permohonan tersebut dapat diteruskan?&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Jawapan:&lt;br /&gt;&lt;br /&gt;Tidak perlu bagi Pentadbir tanah meminta tuan punya tanah melepaskan gadaian terlebih dahulu sekiranya pemegang gadai bersetuju dengan permohoan tuan tanah tersebut. Pihak pemegang gadai hendaklah memberi kebenaran bertulis ke atas permohonan tersebut seperti yang dikehendaki di bawah perenggan (c)subseksyen (1)seksyen 196 ......bahawa tiap-tiap orang atau badan yang dinyatakan dalam subseksyen (2) telah memberi keizinan secara bertulis untuk pembuatan permohonan itu&lt;br /&gt;(2)(a) mana-mana orang atau badan yang pada masa kelulusan itu dipohon, berhak kepada faedah mana-mana kepentingan berdaftar yang menyentuh gadaian tanah itu, mengikut mana-mana yang berkenaan, bahagian yang hendak diserahkan balik (termasuk gadaian mana-mana pajakan atau pajakan kecil) dan catitan hendaklah dibuat atas hakmilik. Setelah disemak didapati Penggunaan Tanah adalah Bangunan dan Syarat Nyatanya adalah Bangunan. Pengadu pernah membuat permohonan tukar syarat Pecah Sempadan daripada pertanian kepada bangunan. Di dalam menyediakan kertas Mesyuarat ke EXCO, Pentadbir Tanah Daerah telah menyatakan dalam syarat kelulusan bahawa syarat nyata tanah adalah bangunan sahaja.Semakan juga telah dibuat ke Unit Hasil untuk mengetahui apakah kadar cukai yang telah dikenakan. Unit Hasil memaklumkan oleh kerana syarat nyata adalah Bangunan, kadar cukai tertinggi bagi bangunan ialah bangunan Perniagaan, Oleh itu pengadu telah dikenakan cukai untuk kadar Bangunan Perniagaan.&lt;br /&gt;Apakah cara penyelesaiannya?&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Cara Pertama.&lt;br /&gt;&lt;br /&gt;Pentadbir Tanah akan mengarahkan supaya dibuat satu siasatan di atas lapangan tanah yang diduduki, samada tanah tersebut telah didirikan Bangunan Kediaman atau Bangunan Perniagaan. Sekiranya tanah tersebut telah didirikan bangunan kediaman, berdasarkan lapuran tersebut boleh di pinda kadar cukai tanah daripada Bangunan Perniagaan kepada Bangunan Kediaman.&lt;br /&gt;&lt;br /&gt;Cara Kedua.&lt;br /&gt;&lt;br /&gt;Pentadbir Tanah akan membuat pembetulan ke atas Kertas Mesyuarat Exco daripada Bangunan kepada Bangunan Kediaman dan menghantar semula ke Exco untuk Kelulusan.&lt;br /&gt;Dengan kelulusan tersebut akan dibuat pindaan atas syarat nyata hakmilik tersebut daripada Bangunan kepada Bangunan Kediaman.Tanpa kelulusan Exco, Pentadbir Tanah tidak mempunyai kuasa untuk membuat pindaaan/pembetulan pada syarat nyata hakmilik tersebut ( SEK 380). Contohnya sebahagian tanah yang berada di dalam Mukim A telah dinaikan taraf kepada Pekan A. Sebelum ini kenaikan taraf ini buat semakan semula setiap 10 tahun sekali. Contohnya pada tahun 1994 dan 2005. Sebenarnya kenaikan taraf ini boleh dibuat tanpa mengira masa atau pada suatu jangkamasa tertentu. Mungkin jangkamasa 10 tahun sekali akan di buat semakan ini dibuat secara kebetulan sahaja supaya sama dengan semakan semula kadar cukai tanah.&lt;br /&gt;Banyak persoalan timbul selepas sesuatu kawasan diisytiharkan terlibat dengan kenaikan taraf.&lt;br /&gt;&lt;br /&gt;Contoh:&lt;br /&gt;1. (Hakmilik Pentadbir)&lt;br /&gt;No. Hakmilik = PM 1234&lt;br /&gt;Mukim        = A&lt;br /&gt;No. PA       = 1234&lt;br /&gt;&lt;br /&gt;2.&lt;br /&gt;No. Hakmilik = HSM 1234&lt;br /&gt;Mukim        = A&lt;br /&gt;No. PT       = 2345&lt;br /&gt;&lt;br /&gt;Contoh:&lt;br /&gt;1. Mana-mana orang atau badan yang menuntut hakmilik,&lt;br /&gt;        atau apa-apa kepentingan yang boleh didaftar.&lt;br /&gt;&lt;br /&gt;     b. Mana-mana orang atau badan yang menuntut yang &lt;br /&gt;        dia berhak mendapat faedah di bawah mana-mana&lt;br /&gt;        amanah yang menyentuh apa-apa tanah atau&lt;br /&gt;        kepentingan sedemikian.&lt;br /&gt;&lt;br /&gt;     c.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;2. Ini kerana saya telah membuatkan setting private/hidden pada fail/folder administrator.Selepas itu pula saya telah menguwudkan satu lagi administrator lain pada laptop tersebut. Tekan kanan dan cari properties&lt;br /&gt;4. Keluar menu general dan sharing&lt;br /&gt;5. Majlis tersebut telah diadakan di Hotel The Palace oF Golden Horses Kuala Lumpur. Perasmian oleh Bekas Perdana Menteri Tun Abdullah Haji Ahamad Badawi/Apabila Penel memaklumkan bahawa penilaian mereka mendapati kurangnya peranan ketua jabatan dalam melaksanakan projek tersebut. Seterusnya iannya lebih dianggap projek peribadi.
